These Terms & Conditions and Privacy Policy (“Agreement”) apply to all services, workshops, private one-on-one sessions, ebooks, digital content, and related activities (“Services”) provided by Berly Canek / Healing Within You LLC (“Practitioner”, “we”, “us”). By registering for or participating in any workshop or private session, or by purchasing or downloading any digital content, you agree to the following:
1. Scope & Nature of Services
- I, Berly Canek, am a certified Trauma-Informed Somatic Practitioner, Trauma-Informed EFT Practitioner, Trauma-Informed Yoga Teacher, Embodiment Coach, and Sound Healer.
- I am not a psychologist, psychiatrist, or licensed medical professional. My services are intended for educational, supportive, and personal growth purposes.
- These Services are not a substitute for medical treatment, psychological therapy, or legal advice. If you have serious mental health or medical concerns, please seek the care of a licensed professional.
2. Registration & Payment
- Full payment is required to secure your spot in workshops, private sessions, or to access ebooks and digital content, unless otherwise agreed in writing.
- Payments are accepted via PayPal, Stripe, Klarna, or other methods provided at checkout.
- For multi-session packages, payment plans may be available.
3. Cancellation & Rescheduling
- Private One-on-One Sessions:
• You may cancel or reschedule up to 24 hours before your session. Payment will be credited toward another session within 60 days.
• Cancellations made less than 24 hours before the scheduled time are considered missed sessions and no credit will be issued.
• If I must cancel, you will be offered an alternative date or a credit toward a future session. - Workshops:
• Cancellations more than 7 days before the workshop start date are eligible for a credit toward another workshop within 6 months.
• Cancellations made less than 7 days before the start date are non-transferable and no credit will be issued.
• If a workshop is cancelled or postponed by me, you will receive a credit toward a future workshop. - Digital Products:
• Ebooks, meditations, guides, and other digital products are non-refundable and non-transferable once purchased or accessed.
4. Intellectual Property
- All workshop materials, ebooks, PDFs, meditations, recordings, and resources are the intellectual property of Berly Canek / Healing Within You LLC.
- You may use these materials for your own personal growth, but you may not copy, reproduce, sell, or distribute them without prior written permission.
- Unauthorized sharing, recording, or resale of any content is strictly prohibited.
5. Confidentiality & Privacy
- All personal information shared during private sessions is confidential, except where disclosure is required by law (e.g., risk of harm, abuse, or court order).
- In workshops or group settings, participants agree to respect the privacy of others. No recording or sharing of other participants’ contributions is permitted.
- Communications (email, WhatsApp, Zoom) are handled securely, but please note that no platform is 100% risk-free

6. Risks & Liability
- Somatic and trauma-informed practices may sometimes bring up emotional intensity. By participating, you accept full responsibility for your emotional and physical well-being during and after the Services.
- Always consult your healthcare provider before beginning new practices if you are pregnant, recovering from injury, or managing a medical or mental health condition.
- To the fullest extent permitted by law, Healing Within You LLC and Berly Canek are not liable for any damages, injuries, or losses arising from your participation in Services or from the use of materials provided.
7. Recordings & Use of Materials
- Some workshops may be recorded for internal purposes or future offerings. Participants will always be notified in advance.
- Your personal information and contributions will not be shared publicly without your written consent.
8. Refunds & Credits
- No refunds will be issued for any Services or digital products.
- Credits may be applied toward future sessions or workshops if cancellation policies are followed.
9. Data We Collect
- We may collect:
• Personal Details: Name, email, phone, billing information when booking or purchasing.
• Sensitive Information: Details you voluntarily share in sessions, workshops, or intake forms.
• Technical Data: IP address, browser type, device, website usage (via cookies/analytics).
• Communications: Emails, messages, or inquiries you send us.
10. How We Use Your Data
- To provide and personalize services.
- To process payments securely (via PayPal, Stripe, Klarna).
- To send booking confirmations, reminders, and resources.
- To improve website and services.
- To send marketing emails only if you opt in (unsubscribe anytime).
11. Your Rights
- Depending on your location (U.S., EU under GDPR, California under CCPA), you may have the right to:
• Access the data we hold about you.
• Request corrections or updates.

13. International Users

14. Governing Law & Disputes
- Governed by the laws of Texas, USA.
- Disputes will first be addressed informally, then through mediation, or in the courts of Travis County, Texas.
